LAHORE: The Lahore High Court (LHC) has directed the Punjab Police to stop submitting the report (challans) under Section 512 of the Code of Criminal Procedure (CrPC) in cases that are related to proclaimed offenders.
Justice Sohail Nasir who was heading the bench during a murder case said that every report whether it is a cognizable or non-cognizable offence should be submitted under Section 173 of the CrPC as Section 512 is not applicable to the submission of challans. Any proceedings under these practices cannot be entitled as a trial in absentia either.
According to the rules book, the evidence should be collected in presence of the accused or his counsel.
He commented that proceedings held under Section 512 are aimed at preserving the evidence.
